Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off Period: the period within which the Consumer may exercise the right to return a product.
Consumer: a natural person who purchases products for personal use and not for business or commercial purposes.
Business Day: any calendar day except weekends and federal holidays.
Durable Medium: any tool that allows the Consumer or Business to store information in a way that enables future access and reproduction.
Right of Return: the option for the Consumer to return a product within the stated return period.
Business / Seller: Monostark, the entity offering products online to Consumers.
Distance Agreement: any contract concluded between the Seller and Consumer via online communication methods without in-person presence.
Communication Technology: any method of remote communication used to conclude an agreement.
Terms and Conditions: the present Terms and Conditions of Monostark.

Article 3 – Applicability

These Terms and Conditions apply to every online offer, purchase, and transaction between Monostark and the Consumer.

Before a purchase is completed, these Terms and Conditions will be made available to the Consumer. If this is not reasonably possible, the Consumer will be informed how to access them electronically or receive them upon request.

If additional product-specific conditions apply, the Consumer may rely on whichever condition is more favorable to them in the case of conflict.

If any part of these Terms becomes invalid, the remainder remains effective, and the invalid clause will be replaced by one that most closely reflects the original intent.

Situations not defined in these Terms shall be interpreted in the spirit of the document.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

All offers are non-binding and may be adjusted at any time.

Product descriptions and images aim to accurately represent the items offered. Minor deviations or obvious errors do not bind the Seller.

Each offer includes clear information about:

  • The price of the product

  • Any applicable shipping costs

  • How the agreement is concluded

  • Return and refund rights

  • Payment and delivery methods

  • Availability and specifications such as size, color, and material


Article 5 – The Agreement

The agreement becomes effective when the Consumer completes the purchase and the Seller confirms the order electronically.

For electronic purchases, the Seller ensures secure data transmission and safe payment environments.

The Seller may verify whether the Consumer can meet payment obligations. If concerns arise, the Seller may cancel or impose conditions on the order.

The Seller will provide the Consumer with:

  • Customer service contact details

  • Return and refund instructions

  • Warranty information

  • Order and product details

All agreements are subject to product availability.


Article 6 – Right of Return (U.S. Return Policy)

Consumers may return products within 14 days of delivery.

During this period, the Consumer must handle the product with care and only inspect it as necessary to determine suitability.

To initiate a return, the Consumer must notify Monostark in writing (email accepted). Products must be returned within 14 days of the notification.

The Consumer is responsible for providing proof of return shipment.

If the Consumer does not initiate or complete the return within the above timeframes, the purchase is considered final.


Article 7 – Return Costs & Refunds

Return shipping costs are the responsibility of the Consumer unless otherwise stated.

Refunds will be issued within 14 days after Monostark receives the returned product or receives proof of shipment.

Refunds apply only to the product price; original shipping charges are non-refundable unless required by law.


Article 8 – Exclusions from Return Policy

The Seller may exclude returns for:

  • Custom-made or personalized items

  • Products of a personal or intimate nature

  • Items that cannot be returned due to their nature

  • Perishable goods

  • Software, audio, or video items with broken seals

  • Hygiene products with broken seals

Any exclusions must be clearly stated at the time of purchase.


Article 9 – Pricing

Prices will not increase after the Consumer places an order, except where required by law.

Prices may fluctuate based on market conditions; such variability will be disclosed when applicable.

All prices are listed without typographical obligations. Obvious pricing errors do not obligate the Seller to fulfill the order.


Article 10 – Conformity and Warranty

Monostark ensures that products match the stated descriptions and meet reasonable standards of quality.

Warranty coverage follows manufacturer guidelines unless otherwise stated.

Issues or defects must be reported within 14 days of delivery.

Warranty does not apply if:

  • Products were altered or repaired by the Consumer

  • Products were used improperly or negligently

  • Damage resulted from non-compliance with instructions


Article 11 – Delivery and Execution

The Seller processes orders with the highest level of care.

Delivery occurs to the address provided by the Consumer.

Orders will be shipped within 30 days unless otherwise agreed. If delays occur, the Consumer will be notified and may cancel the order for a full refund.

The risk of loss or damage transfers to the Consumer upon delivery.

If an item is unavailable, a comparable replacement may be offered with clear communication.


Article 12 – Subscriptions (If Applicable)

Consumers may cancel ongoing subscription services with a maximum notice period of one month.

Subscriptions will not automatically renew for set periods without the Consumer’s clear consent.

Trial subscriptions end automatically unless otherwise confirmed by the Consumer.


Article 13 – Payment

Unless otherwise agreed, payments must be completed at checkout.

The Consumer is responsible for ensuring accurate payment information.

In cases of non-payment, the Seller may charge reasonable recovery fees as permitted by U.S. law.


Article 14 – Complaints Procedure

Complaints must be reported within 7 days of identifying an issue.

The Seller will respond within 14 days. If more time is needed, the Consumer will be informed of the delay and expected resolution time.

A complaint does not suspend payment obligations unless explicitly confirmed by the Seller.

If a complaint is valid, the Seller may offer repair, replacement, or refund.


Article 15 – Governing Law

All agreements between Monostark and the Consumer are governed exclusively by the laws of the United States and the State in which the business is registered, regardless of the Consumer’s location.
